Service use terms

1. Eligibility to use the Service

The Service is available only to individuals aged 18 or over. By accessing it, you confirm that you meet this age requirement and are legally able to accept these Terms. Use is not permitted where applicable law prohibits it.

2. Creating an account

Full use requires account details that are complete, accurate and up to date. Keep your login credentials secure and accept responsibility for activity through your account. Contact us without delay at [email protected] if you suspect unauthorised access to your account.

We may restrict or close accounts that violate these Terms, contain deceptive information or are connected with fraud or misuse.

3. Service scope and restrictions

Meritholt Invest provides multi-asset research supported by AI, trading alerts and, when offered, automated order placement through connected brokerage accounts. The Service is provided for information and analysis only.

• Meritholt Invest does not take possession of, safeguard or manage your funds. Your money stays in the brokerage or exchange account that you control.
• We connect to your broker through API keys configured for reading and placing orders only. These permissions do not allow withdrawals.
• Past performance from a strategy or signal is not an indication of future performance.
• Trading may lead to losses, including the loss of part or all of your initial capital.

4. No investment advice

Information made available on the platform Meritholt Invest does not constitute financial, investment, trading or professional advice. AI-generated analysis and signals are informational aids only. Consult a qualified financial adviser before deciding to invest. Meritholt Invest is not registered as an investment adviser, dealer or financial planner.

5. Charges and payments

Some Service features are available only with a paid subscription. Prices are shown on the pricing page and may be amended with 30 days’ notice. Applicable taxes are excluded from fees and remain your responsibility. Plans are billed in advance on a monthly or annual basis. At our discretion, a new subscriber may qualify for a refund within 14 days of the initial payment.

6. Permitted use

You agree not to:

• Use the Service unlawfully or in breach of applicable legislation.
• Attempt to decompile, disassemble or retrieve the platform source code.
• Use automated software to scrape, crawl or gather information from the Service.
• Resell, sublicense or use any part of the Service commercially without prior written permission.
• Damage, disrupt or reduce the availability, security or performance of the Service or connected systems.
• Engage in market manipulation, front-running or other behaviour that violates financial rules.

7. Intellectual property rights

All Service materials, including text, software, algorithms, trademarks and confidential know-how, are owned solely by Meritholt Invest or its licensors. These Terms do not transfer ownership or any proprietary rights in those materials. You must obtain written consent before using our trademarks, logos or names.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY TYPE, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Meritholt Invest WE MAKE NO PROMISE THAT THE SERVICE WILL ALWAYS BE ACCESSIBLE, RUN ERROR-FREE OR BE CLEAR OF VIRUSES OR OTHER HARMFUL CODE.

9. Limits on liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Meritholt Invest WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST INFORMATION, TRADING LOSSES OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED THAT SUCH DAMAGE WAS POSSIBLE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO Meritholt Invest IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnity

You agree to indemnify, defend and hold harmless Meritholt Invest and its directors, officers, employees and agents from claims, liabilities, damages, losses and costs, including reasonable legal fees, arising from your use of the Service, breach of these Terms or infringement of another party’s rights.

11. Term and termination

You may close your account through account settings or by contacting [email protected]. We may suspend or end access immediately after a breach of these Terms. Once access ends, your authorisation to use the Service also ends, and account information may be deleted in accordance with our Privacy Policy.

12. Applicable law and dispute resolution

These Terms are governed by the laws of Meritholt Invest, without applying conflict-of-law rules. Disputes must first be resolved through binding arbitration in 200 Park Avenue, New York, NY 10166, United States under American Arbitration Association rules. Users in the EU or UK may also bring complaints before courts available in their local jurisdiction.

13. Revisions to these Terms

We can amend these Terms periodically. If a significant change is planned, we will notify you by email or through a Platform message at least 14 days beforehand. Using the Service after the change takes effect means you agree to the updated Terms.
